Default Vendor Refused to Refund

Well, the Primeval-EA vendor refuses to refund my money. Here is the email transscription:

I agree we had things to correct and they were corrected already, the EA works great and will be better in every update.

In first full month of trading (March 10th-April 6th inclusive), the scalping only Primeval-EA lost 45.0 pips and lost $167.44. These figures are based on all eight scalping pairs.

As you can see, the vendor keeps wanting me to keep running this loosing EA while not honoring their refund agreement. The vendor has changed the refund agreement and nothing leads me to believe that they will honor the now changed agreement.

I have now went to Plimus and asked them for a refund.
